Court fees, litigation costs and claim value
Court fees are statutory charges for judicial procedures. Litigation costs may also include representation, experts and other necessary expenditure. The value in dispute is an assessment basis, not the total cost bill or guaranteed recovery.
Distinguish the concepts
The initial court fee differs from the cost of an entire case. Additional steps, hearings or evidence may generate further items. An obligation to advance costs is distinct from later reimbursement by the opponent. A favourable costs decision also does not establish the opponent’s ability to pay.
Jurisdiction and scope
Austria applies its own court fees and lawyer tariff rules. Its lawyer tariff legislation is relevant to tariff-based costs and reimbursement; individually agreed remuneration is a separate matter. Germany has different fees and cost rules. Do not copy Austrian figures into a German application. This website’s calculator covers only its stated procedure and value range.
Illustrative business example
A business assesses court action for an unpaid invoice. It records claim value, procedure, possible representation and known objections. Beyond the initial fee model, it considers disputed proceedings and practical recoverability. Deciding solely from one displayed calculator figure would omit relevant factors.
Common questions
Is the claim value the fee?
No. It may inform the calculation; the applicable rules and procedural step determine the fee.
Who pays initially?
Advance-payment duties depend on the procedure and expense. Later recovery of costs is a separate question.
Does a payment-order calculator cover everything?
Only to the extent explicitly and accurately stated. Representation, evidence or appeals must not silently be treated as included.
