German payment order (Mahnbescheid)

A Mahnbescheid is the initial court payment document in Germany’s payment-order procedure. It sets out the asserted claim and the opportunity to object. It is not yet a Vollstreckungsbescheid and does not by itself permit enforcement.

Engagement and acceptance are governed by the terms.

Distinguish the concepts

At this stage, the payment-order court does not perform a full substantive examination of the asserted debt. A prior business reminder and the court order are separate steps. Known objections, incorrect parties and payments already received remain relevant even if an application is processed electronically.

Jurisdiction and scope

The German procedure applies to eligible claims for a specified monetary amount. The order requests payment or an objection within two weeks. Those two weeks are not an absolute cut-off for every later objection: whether the enforcement order has already been ordered also matters. Check the actual procedural position.

Illustrative business example

A business applies for a payment order, then receives a payment. It updates the amount being pursued instead of applying for an enforcement order for the original sum. Service, response and balance are documented together. Following an objection, the business must decide whether and how to pursue the matter through disputed proceedings.

Common questions

Is a Mahnbescheid already an enforcement title?

The initial payment order is not itself an enforcement title. A possible enforcement order is a separate stage.

What happens after an objection?

The disputed claim may move to ordinary proceedings. Requirements, applications, evidence and further costs need separate assessment.

Can I use it for a purely Austrian case?

The German procedure does not replace assessment of international and subject-matter jurisdiction. Austria has its own payment-order route.
