Payment deadlines and limitation: Austria and Germany

The payment deadline and the limitation period serve different purposes. The date in your letter requests payment by a specific day. Limitation concerns the legal enforceability of your claim.

Which payment deadline should I choose?

First check the agreed due date and payments already received. The template suggests a new payment deadline 14 days after the letter date. This is editable, not a statutory reminder period. Allow for receipt of the letter, existing agreements and the circumstances.

AT

Austria

When to send a reminder?

Check when payment is due under the contract and performance. There is no general requirement to send three reminders. WKO: late payment

Which limitation period?

Business claims for goods, work and other services generally have a three-year limitation period. RIS: statutory basis It generally starts when the claim is due, rather than automatically at year-end. For work remuneration, invoicing and when it was objectively possible can matter; delaying the invoice cannot postpone the start indefinitely. Supreme Court: commencement

Does a reminder stop time running?

A reminder alone does not interrupt limitation. An acknowledgement or a timely claim in court that is duly pursued can be relevant. RIS: interruption

DE

Germany

When to send a reminder?

A reminder after payment is due can establish default. It may be unnecessary in certain cases, such as a payment date contractually fixed by the calendar. Three reminders are not mandatory. Statutory default rules

Which limitation period?

Normally three years from the end of the year when the claim arose and you knew, or should have known without gross negligence, the circumstances and debtor. If these conditions are met in 2026, the ordinary period generally ends on 31 December 2029, absent suspension or restart. IHK: commencement

Does a reminder stop time running?

An out-of-court reminder alone does not suspend limitation. Court proceedings or negotiations may matter subject to their respective requirements. IHK: suspension

Three years is not a universal rule. The type of claim, agreements and earlier actions can change the assessment. Have older or disputed claims assessed in time; this generator does not calculate a limitation date.

Check before sending

  • Has the agreed service been provided and is the entered balance still outstanding? Account for payments and credit notes.
  • Do the contracting parties, invoice number, invoice date and due date match your records?
  • Is the new payment deadline appropriate to the circumstances? A preset date is not a statutory deadline.
  • Are there objections, an instalment agreement or indications of insolvency? Clarify these before using the template unchanged.
  • Check the bank details and retain the invoice, correspondence and evidence of delivery.

The next step

Your customer still has not paid?

Hand your unpaid invoice over to incaseof.law. Register in the customer portal, then enter the claim with the invoice and relevant records. The engagement is subject to the applicable terms.

Already have an account? Open the customer portal

If limitation is approaching, a reminder or simply handing the claim to a collection agency is not sufficient to preserve the deadline. Arrange a timely assessment of the legal steps required.

Common questions

Are the online template and downloads free?

Yes. Fill in the online template and download your completed letter as Word or PDF without registration. Free access applies to these tools; a later collection engagement is a separate step subject to its own terms.

Do I need to send all three letters in sequence?

No. The variants help with wording in different situations; they are not a mandatory sequence. Check the due date, agreements and previous correspondence.

Do the letters include reminder fees or late payment interest?

No. The letter requests only the outstanding invoice amount you enter. Any entitlement to additional items depends on the circumstances and applicable law. Check these separately before sending an edited document.

Are my invoice details stored or sent anywhere?

The generator processes your entries in the browser and does not send them to incaseof.law. It does not store them in cookies or browser storage. Downloaded files and copied text remain on your device. The generator does not send messages.

Can I send a payment reminder by email?

An ordinary reminder generally does not require a particular form. Check any different contractual arrangements, make the payment request clear and consider evidence of receipt. A saved draft or sent email alone does not prove receipt.
