Enforcement in Germany: the next step after a court title

An enforceable title can provide a route to enforcement when the relevant requirements are met. It is not a payment. Before pursuing a titled claim, prepare the correct title, service documents, current balance and information about previous measures.

How do a title and a payment differ?

A German enforcement order can provide the legal basis for measures against a debtor’s assets. Whether money is recovered also depends on attachable assets or income and which measure is lawful and appropriate in the individual case.

Once the enforcement order has been issued, the payment-order court's role in that procedure ends. Enforcement has separate authorities and rules. Record an existing title separately from a payment actually received.

Which documents belong in the file?

  • The complete title and the version required for the specific measure.
  • Available service records and court communications.
  • An intelligible statement of the claim, payments and costs.
  • Records of previous enforcement attempts.
  • Known current address, insolvency information and objections.

Keep originals secure. The official court explanation refers to the enforceable copy for the enforcement process it describes. A scanned invoice does not replace a court title. Check the required format for the particular submission channel before applying.

How do you maintain a reliable balance?

Distinguish the amount originally established in the title from subsequent interest, costs and payments. Each change needs a date, basis and allocation. An old demand letter is not a reliable current statement if partial payments have since been received.

Practical preparation: Create a chronological list with amount, booking date, supporting record and allocation. In an ongoing engagement, observe the agreed allocation order. Do not add each historical statement to the amount in the title again.

Which next measure makes sense?

Depending on the case, different enforcement routes may be available, including a bailiff's actions or attachment of a receivable. The choice needs a specific factual basis. More measures do not automatically improve the economic prospects and can generate additional costs.

Before proceeding, clarify the required instruction, expected costs and known obstacles. Insolvency proceedings or a challenge to the title require separate assessment. The title's age alone is not enough to recommend a step.
