German payment orders: application and next steps
A German Mahnbescheid is a court document concerning a specified monetary claim. It does not replace checking your evidence or guarantee payment. Before applying, clarify the claim, parties, jurisdiction and costs. An objection changes the subsequent procedural route.
When can a German payment order be used?
The German procedure concerns specified monetary claims in euros. It is excluded, for example, where the claim depends on consideration that has not yet been provided. Service and other statutory requirements also matter. An outstanding invoice alone does not settle those questions.
An application is not a court finding that your account of the facts is correct. Check the contract, performance, due date, payments and known objections first. An anticipated dispute should inform the choice of procedure.
Which information do businesses need?

Keep evidence organised even where the standard application does not request it in the same way as a fully pleaded civil claim. A subsequent dispute requires a substantiated account of the claim.
What happens after service?
The defendant may pay or object. The payment-order court informs the applicant of procedural developments. Any payment made directly to you must be reflected in subsequent information and promptly reported where a collection instruction is ongoing.
If the defendant objects and you wish to pursue the claim, contested proceedings are required. This creates a new decision about evidence, effort and legal representation where applicable. A partial objection may lead to different routes for disputed and undisputed amounts.
When does an enforcement order follow?
A Vollstreckungsbescheid may be requested when the procedural requirements are met. Deadlines and actual payments must be considered; continuing to send internal reminders does not produce the next court document.
The enforcement order may provide a basis for enforcement. Enforcement itself is a separate step with its own requirements and costs. Your accounts team should therefore distinguish “payment order”, “title obtained” and “paid”.
