Collection costs
Collection costs arise from a provider handling a claim. The client’s contractual payment obligations and the amount recoverable from the debtor are separate legal questions.
Distinguish the concepts
Principal may sit alongside interest, out-of-court recovery costs, court fees and lawyer costs. These items have different bases. A tariff does not automatically prove that every measure was necessary or every amount recoverable from the debtor. Similarly, “no success commission” does not mean that every possible additional expense is excluded.
Jurisdiction and scope
Austria requires attention to necessary, appropriate recovery measures and proportionality to the claim. Germany’s RDG limits recoverable collection costs by reference to the corresponding lawyer remuneration. This ceiling does not replace assessment of the underlying entitlement and actual expense.
Illustrative business example
After handover, a customer pays part of the balance directly to the business. Accounts should not assume the entire amount reduces principal. Notification, allocation and contractual settlement need reconciliation. incaseof.law’s terms specify the order for collection costs, interest, other costs and principal.
Common questions
Who bears collection costs?
Assess the service contract separately from any claim for reimbursement against the debtor. Ability to pay and actual recovery remain additional issues.
What changes with court action?
Court, representation and transmission costs may arise. An out-of-court cost explanation does not automatically cover them.
