Standard contract terms
Standard contract terms are pre-formulated conditions intended for repeated agreements. Their incorporation into a specific contract and their validity require separate assessment. A link to a terms page does not establish either point by itself.
Distinguish the concepts
An individual offer describes the instruction; standard terms commonly address acceptance, cooperation, costs and settlement. A privacy notice serves a different purpose by explaining personal-data processing. A privacy acknowledgement or account registration therefore does not by itself prove that a particular collection instruction was accepted. Keep the instruction, acceptance and applicable terms version together.
Jurisdiction and scope
Austria and Germany apply their own rules on incorporation and fairness. Consumer and business transactions must not be treated identically. Even in business dealings, a signature does not make every pre-formulated clause unrestrictedly valid. Practical assessment includes the wording, how and when it was agreed, and any individual arrangements.
Illustrative business example
One employee submits a claim while another consults an older pricing summary. Before approving expenses, the business reconciles the instruction and applicable conditions. Common questions
Does the newest website version always apply?
No. An existing instruction depends on the version actually agreed and any effective subsequent changes.
Are terms and privacy one consent?
No. Contract conditions and information about personal-data processing have different purposes.
What should be retained?
Offer, instruction, acceptance, incorporated terms and individual agreements so that payment and cooperation obligations remain traceable.
