Due date

The due date is the point from which performance can be demanded. It follows from the contract and rules applicable to that performance. An invoice records billing; its date does not determine when every claim becomes due.

Engagement and acceptance are governed by the terms.

Distinguish the concepts

Creation, maturity, default and enforceability are different questions. A claim may exist while the agreed payment period is still running. Conversely, counterclaims or valid objections can affect recovery even after the scheduled payment date has arrived.

Jurisdiction and scope

German law contains general rules on the time of performance and special provisions, for example for remuneration under a contract for work. Acceptance of the work may matter. In Austria, the agreement and contract type also matter, with separate rules on default. A workflow for goods invoices should not be applied automatically to every service or construction claim.

Illustrative business example

A contractor issues a final invoice before the agreed acceptance has been documented. The full amount appears in receivables. Before sending a demand, the business checks the acceptance and payment agreement, completed work and any objections. Invoice, contract, performance evidence and current balance belong in the same file.

Common questions

Can an invoice note alone change the due date?

A unilateral note does not automatically replace the contractual agreement. Establish the basis for the payment deadline.

Does maturity always mean immediate default?

No. The applicable conditions for default need separate consideration.

What should the handover contain?

A supportable due date and its basis. Clarify uncertain prerequisites before a regular collection instruction.
