Instalments and acceleration
An instalment agreement spreads payment across several dates. Acceleration makes remaining instalments due early where the relevant conditions are met. Missing one instalment does not automatically make every outstanding amount immediately payable in every situation.
Distinguish the concepts
A plan should clearly record amounts, dates, charges, interest and allocation. It may also raise questions about deferral or acknowledgement. Do not infer these effects merely from the heading “payment plan”. Accounts needs to know whether timing alone changes or the underlying claim is altered.
Jurisdiction and scope
Austria and Germany have specific protections for certain consumer-credit arrangements. Acceleration conditions may concern arrears, notice and an additional payment period. Do not transfer these rules indiscriminately to every business transaction or disregard them for consumers. Assess contract type, effective agreement and actual arrears before acting.
Illustrative business example
A customer agrees monthly payments and pays twice before missing the next instalment. The business reconciles bank records and due dates, then checks contractual and statutory consequences with the responsible handler. It does not automatically demand the original full sum. All receipts remain visible in the statement.
Common questions
Is a promised instalment already payment?
No. Schedule, due date and actual receipt are separate records.
When can the remainder be demanded?
Only when the applicable contractual and statutory conditions are met. A universal automatic rule is inappropriate.
Can I agree new instalments after handover?
Coordinate with the instructed provider and observe assignment, authority and reporting duties under the agreement.
