Limitation of claims

Limitation restricts judicial enforcement of a claim after the applicable period. The duration, starting point and events affecting that period depend on the claim and jurisdiction.

Engagement and acceptance are governed by the terms.

Distinguish the concepts

An accounting write-off is separate from legal limitation. A provider closing a case does not itself determine limitation either. Suspension, interruption and a fresh start describe different effects and should not be treated as interchangeable labels for every reminder or contact.

Jurisdiction and scope

Germany’s regular period is three years; its year-end start depends on statutory conditions including knowledge requirements. Special periods may apply. Austria also has three-year periods for certain claims, but not a general German-style year-end mechanism for every invoice. Identify the claim type and actual starting point.

Illustrative business example

A business reviews older receivables before year-end. Instead of applying one date to every invoice, it checks the contract, maturity, prior court steps and potentially relevant statements. If expiry is approaching, an appropriate protective measure must be clarified in time. Sending another ordinary reminder or uploading a claim to a provider does not replace that assessment.

Does every reminder interrupt limitation?

No. Do not rely on an ordinary reminder alone to preserve time. The statutory events are decisive.

Do Austria and Germany share the same three-year rule?

No. Matching numbers of years do not mean matching scope or starting dates.

What belongs in a deadline file?

Claim type, governing law, relevant dates and evidence, plus the recorded reasoning for the start and any changes to the period.
