Jurisdiction and the competent court
Jurisdiction identifies the competent forum for a court case. Territorial venue, international jurisdiction and subject-matter competence are distinct questions. Cross-border claims require them to be considered together before filing.
Distinguish the concepts
Applicable law and the competent court are not the same. A collection provider’s location does not automatically establish venue for your claim. A contractual clause may matter but must be effective and applicable. Consumer protections or exclusive jurisdiction can restrict a preferred forum.
Jurisdiction and scope
Domestic cases follow Austrian or German jurisdiction rules. EU matters additionally require assessment of European international-jurisdiction rules. Labelling an invoice AT or DE is insufficient. Consider identity, domicile or company seat, contract subject, performance circumstances and agreed clauses.
Illustrative business example
An Austrian supplier delivers to a German customer. The agreement contains both a choice-of-law provision and a separate jurisdiction clause. Before a payment-order application, the business checks both and the customer’s status rather than selecting the most convenient online form. This reveals potential jurisdiction problems and associated expense earlier.
Common questions
Is the creditor’s local court always competent?
No. The creditor’s location is not a universal rule for every claim.
Does choice of law determine the court?
No. Applicable law and court jurisdiction are separate questions.
What information is needed?
Contract, parties, locations, place of performance, transaction type and clauses, updated for relevant changes.
